We find in Musnnif Abdur Razaq bin Hamam al Sana’ani

(حديث مرفوع) عَنِ ابْنِ جُرَيْجٍ ، عَنْ عَطَاءٍ ، قَالَ : لأَوَّلُ مَنْ سَمِعْتُ مِنْهُ الْمُتْعَةَ صَفْوَانُ بْنُ يَعْلَى ، قَالَ : أَخْبَرَنِي ، عَنْ يَعْلَى ، ” أَنَّ مُعَاوِيَةَ اسْتَمْتَعَ بِامْرَأَةٍ بِالطَّائِفِ فَأَنْكَرَتْ ذَلِكَ عَلَيْهِ ، فَدَخَلْنَا عَلَى ابْنِ عَبَّاسٍ ، فَذَكَرَ لَهُ بَعْضُنَا ، فَقَالَ لَهُ : نَعَمْ ، فَلَمْ يَقِرَّ فِي نَفْسِي حَتَّى قَدِمَ جَابِرُ بْنُ عَبْدِ اللَّهِ ، فَجِئْنَاهُ فِي مَنْزِلِهِ ، فَسَأَلَهُ الْقَوْمُ عَنْ أَشْيَاءَ ، ثُمَّ ذَكَرُوا لَهُ الْمُتْعَةَ ، فَقَالَ : نَعَمْ ، اسْتَمْتَعْنَا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ” ، وَأَبِي بَكْرٍ وَعُمَرَ ، حَتَّى إِذَا كَانَ فِي آخِرِ خِلافَةِ عُمَرَ ، اسْتَمْتَعَ عَمْرُو بْنُ حُرَيْثٍ بِامْرَأَةٍ سَمَّاهَا جَابِرٌ فَنَسِيتُهَا ، فَحَمَلَتِ الْمَرْأَةُ , فَبَلَغَ ذَلِكَ عُمَرَ , فَدَعَاهَا فَسَأَلَهَا ، فَقَالَتْ : نَعَمْ ، قَالَ : مَنْ أَشْهَدَ ؟ قَالَ : عَطَاءٌ لا أَدْرِي , قَالَتْ : أُمِّي أُمَّ وَلِيِّهَا ، قَالَ : فَهَلا غَيْرَهُمَا ، قَالَ : خَشِيَ أَنْ يَكُونَ دَغْلا الآخَرُ ، قَالَ عَطَاءٌ : وَسَمِعْتُ ابْنَ عَبَّاسٍ , يَقُولُ : يَرْحَمُ اللَّهُ عُمَرَ ، مَا كَانَتِ الْمُتْعَةُ إِلا رُخْصَةً مِنَ اللَّهِ عَزَّ وَجَلَّ , رَحِمَ بِهَا أُمَّةَ مُحَمَّدٍ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَوْلا نَهْيُهُ عَنْهَا مَا احْتَاجَ إِلَى الزِّنَا إِلا شَقِيُّ 

Abdur Razzaq, from Ibn Jurayj, from ‘Ataa ibn Abi Rabah who said:

The first one who I heard about muta’a from was Safwaan ibn Ya’alaa and he said, “My father narrated to me that Mawia did muta’a in Ta’if.”

But, I denied attributing that to him. So, we entered upon Ibn ‘Abbas and mentioned some of that to him and he said, “Yes.” But, I did not recognize this in my soul.

That was, until we were presented to Jabir ibn ‘AbdAllah, and we came to his house. So, the people asked him about various things until muta’a was mentioned.

He said, “Yes, we did muta’a during the lifetime of the Prophet, and Abu Bakr, and ‘Umar, until it was in the later part of ‘Umar’s caliphate. ‘Umar ibn Hareeth did muta’a with a woman.” Jabir named her, but I forgot her name. “The woman became pregnant, so that reached ‘Umar and he summoned her and asked her about it…”

‘Ata then said, “I heard Ibn Abbas say, ‘Allah have mercy on ‘Umar, mut’ah was nothing but a concession from Allah, with which he gave mercy to the ummah of Muhammad. If it was not banned, none would commit adultery except a wretched person.'”

All Narrators of This Narration are Trustworthy, and that of Bukhari and Muslim. The only objection which can be raised is in regards to Mu’anan of Ibn Juraij from A’ta. However, Sheikh Albany has clarified this by saying


فقد روى أبو بكر بن أبي خيثمة . بسند صحيح عن ابن جريج قال : ( إذا قلت : قال عطاء فإنا سمعته منه وإن لم أقل سمعت ) . قلت : وهذه فائدة هامة جدا تدلنا على أن عنعنة ابن جريج عن عطاء في حكم السماع

 Abu bakar bin abi Khuthaima narrates with sahih sanad from ibn Juraij that he said: When I says, Ata said, i have heard from him, i do not say “i heard”. I (albany) say that there is great benefit in this which is proof on the fact that mu-An-An of ibn Juraij from Ata comes under the order of HEARING

Sheikh Ibn Baaz says

 وأما معاوية فأخرجه عبد الرزاق من طريق صفوان بن يعلى بن أمية ، أخبرني يعلى أن معاوية استمتع بامرأة بالطائف ، وإسناده صحيح

And Mawia, Abdur Razaq mentioned with Chain of Safwan, who said told me Ya’ala that Mawia did Muta’a with girl in Taif, And chain of the Narration is Authentic
